DEPARTMENT OF CHILD SUPPORT SERVICES

Under California law, the recipient of a child support order has the right to obtain free legal services from the Department of Child Support Services. These free legal services can include the following:

  • Obtaining support orders
  • Enforcement of existing support orders
  • Modification of existing support orders
  • Enforcement of orders out of state

Authority of the Department of Child Support Services

The Department of Child Support Services is empowered to report support delinquencies to the Franchise Tax Board and intercept tax refunds that would be due to the payer of child support. The Department of Child Support Services has the ability to request the State of California revoke a driver’s license or professional license issued to a delinquent child support payer.

Hearings at the Department of Child Support Services

The Department of Child Support Services has a complex set of rules and conducts hearings in departments different than those normally assigned to Family Law. When the Department of Child Support Services is involved, it is possible to have court proceedings contemporaneously being held in two different departments while the same dissolution action is pending.
